Komod Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Komod mobile application, website, and related services (collectively, “Komod”, the “Service”, or the “App”).
By creating an account or using Komod, you agree to these Terms. If you do not agree with these Terms, please do not use the Service.
If you are a consumer, nothing in these Terms is intended to limit or exclude any mandatory rights or protections that apply to you under applicable consumer-protection law.
1. About Komod
Komod is a digital wardrobe and AI-powered styling service designed to help you organize the clothes you own and discover outfit ideas.
Depending on the features available to you, Komod may allow you to:
- create and manage a digital wardrobe;
- upload and organize photographs of clothing;
- receive personalized outfit recommendations;
- generate outfits using artificial intelligence;
- select specific wardrobe items to include in an outfit;
- receive recommendations based on factors such as style, occasion, and weather; and
- access additional features through paid subscriptions.
Komod is a lifestyle and fashion service. Its recommendations are provided for informational and inspiration purposes and are not professional advice.
2. Eligibility
You may use Komod only if you are legally permitted to enter into a binding agreement under the laws applicable to you.
If you are using Komod on behalf of another person or organization, you confirm that you have the authority to accept these Terms on their behalf.
You are responsible for complying with all laws applicable to your use of the Service.
3. Your Account
Certain features require you to create an account.
You agree to provide information that is accurate and reasonably up to date.
You are responsible for maintaining the security of your account and for activity carried out through your account.
If you believe that your account has been accessed without authorization, you should contact us promptly at [email protected].
4. Your Use of Komod
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use Komod for its intended purposes.
You must not:
- use Komod for an unlawful purpose;
- attempt to gain unauthorized access to Komod or its systems;
- interfere with or disrupt the Service;
- introduce malicious code or harmful software;
- use automated systems to access Komod in a way that places unreasonable load on our systems;
- reverse engineer, decompile, disassemble, or attempt to derive source code from the App except to the extent such activity cannot legally be restricted;
- copy, reproduce, distribute, sell, sublicense, rent, or commercially exploit Komod or its proprietary content without our permission;
- circumvent usage limits or technical restrictions;
- use Komod to infringe another person's rights; or
- use the Service in violation of applicable law.
Nothing in these Terms restricts rights that cannot legally be restricted.
5. Your Content
You may upload photographs and other information relating to your wardrobe (“User Content”).
You retain ownership of your User Content.
To provide Komod, we need permission to store, process, transmit, and technically reproduce your User Content as necessary to operate the Service.
Accordingly, you grant Komod a limited, worldwide, non-exclusive, royalty-free license to use your User Content solely as reasonably necessary to:
- provide and operate Komod;
- store and display your wardrobe;
- process your wardrobe through features you request;
- generate outfit recommendations;
- maintain and secure the Service; and
- provide technical support.
This license does not transfer ownership of your User Content to Komod.
We will process personal data contained in User Content in accordance with our Privacy Policy.
You are responsible for ensuring that you have the necessary rights to upload content to Komod.
You should not upload photographs containing other people unless you have the necessary permission or another lawful basis to do so.
6. AI-Generated Recommendations
Komod uses artificial intelligence and automated systems to generate outfit recommendations.
AI-generated recommendations may sometimes be incomplete, inaccurate, unsuitable, or inconsistent.
For example, generated recommendations may not always accurately reflect:
- colors;
- patterns;
- proportions;
- garment characteristics;
- weather conditions;
- personal preferences;
- suitability for a particular occasion; or
- how clothing will look when worn together.
AI-generated recommendations are provided for general fashion inspiration and informational purposes only.
You are responsible for deciding whether a recommendation is suitable for you.
Komod does not provide professional fashion, medical, health, financial, legal, or other regulated advice.
7. Service Availability
We aim to keep Komod reliable and available, but we do not guarantee that the Service will always be:
- available;
- uninterrupted;
- error-free;
- secure;
- accurate; or
- compatible with every device or software environment.
The Service may occasionally be unavailable because of maintenance, updates, technical problems, third-party services, network issues, security incidents, or circumstances outside our reasonable control.
We may modify, improve, suspend, or discontinue features of Komod from time to time.
Where applicable law gives you mandatory rights concerning changes to a paid digital service, those rights remain unaffected.
EU rules governing digital services provide consumers with mandatory rights concerning supply, conformity, remedies, and certain modifications to digital services.
8. Free Features and Usage Limits
Komod may provide certain features without payment.
Free features may be subject to reasonable usage limits, including limits on:
- the number of wardrobe items;
- AI outfit generations; or
- other features.
Usage limits may change over time.
Changes to a paid subscription or its included functionality will be handled in accordance with applicable law and the terms applicable to that subscription.
9. Subscriptions
Komod may offer optional auto-renewable subscriptions that provide access to additional features or higher usage limits.
Before purchasing a subscription, you will be shown the applicable:
- subscription price;
- billing period;
- included features or limits; and
- other material purchase information.
Subscriptions purchased through Apple's App Store are processed through Apple's in-app purchase system.
Your Apple subscription is also subject to Apple's applicable terms and conditions.
Subscriptions generally renew automatically unless cancelled before the applicable renewal date.
You can manage or cancel an App Store subscription through your Apple Account subscription settings.
Apple's current Media Services Terms contain the applicable provisions governing App Store subscriptions, billing, cancellation and related matters.
Komod does not receive or store your full payment-card details when payment is processed through Apple's App Store.
10. Refunds and Consumer Rights
If you purchase Komod as a consumer, you retain any mandatory consumer rights available to you under applicable law.
For purchases made through Apple's App Store, refund requests and payment-related matters may be handled through Apple in accordance with Apple's applicable policies and terms.
Nothing in these Terms excludes or limits any statutory right to a refund, price reduction, termination, or other remedy that cannot legally be excluded.
EU law provides consumers of digital services with certain mandatory remedies where a digital service is not supplied or does not conform to the contract.
11. Right of Withdrawal
Consumers in the European Union may have a statutory 14-day right of withdrawal for certain online contracts.
However, EU consumer law provides specific rules concerning digital services and digital content where performance begins during the withdrawal period.
Where applicable law permits the withdrawal right to be excluded because the consumer has requested immediate performance and has expressly acknowledged the relevant consequences, the applicable requirements will apply.
Nothing in these Terms is intended to remove a mandatory withdrawal right.
12. Intellectual Property
Komod, including its software, interface, design, branding, logos, trademarks, text, graphics, and underlying technology, is owned by or licensed to Komod and is protected by applicable intellectual-property laws.
Except for the limited rights expressly granted in these Terms, no ownership or other intellectual-property rights are transferred to you.
You may not use Komod's name, logo, trademarks, or proprietary materials without our prior permission.
13. Generated Content
To the extent permitted by applicable law, you may use outfit recommendations and other content generated for you by Komod for your personal use.
Because generated content may be produced using automated systems, Komod does not guarantee that every generated result is unique or independently eligible for copyright protection.
Nothing in these Terms transfers ownership of your original User Content to Komod.
14. Third-Party Services
Komod may use third-party services to provide certain functionality, including authentication, infrastructure, weather information, AI processing, subscription management, analytics, security, and other technical services.
Third-party services may be governed by their own terms and privacy policies.
Our processing of your personal data through third-party providers is described in our Privacy Policy.
15. Suspension and Termination
You may stop using Komod at any time.
You may request deletion of your account in accordance with our Privacy Policy.
We may suspend or terminate your access where reasonably necessary, including if:
- you materially breach these Terms;
- you use the Service unlawfully;
- you attempt to circumvent security or usage restrictions;
- your use creates a security or technical risk;
- you abuse the Service; or
- we are required to do so by law.
Where appropriate and legally required, we will provide reasonable notice before terminating or restricting access.
Termination does not affect rights or obligations that arose before termination.
Mandatory consumer rights remain unaffected.
16. Disclaimer
To the maximum extent permitted by applicable law, Komod is provided on an “as available” basis.
We do not guarantee that:
- every recommendation will be accurate;
- the Service will always be available;
- AI-generated results will always be error-free;
- every feature will remain available indefinitely; or
- the Service will meet every individual preference or expectation.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Komod will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from your use of the Service.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms limits mandatory consumer protections or liability that cannot legally be limited or excluded.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to Komod, our services, technology, or applicable law.
If we make material changes, we will provide reasonable notice where required.
The updated Terms will be published on our website and/or made available through the App.
For paid digital services, changes that negatively affect your access to or use of the Service will be made only in accordance with applicable law.
19. Governing Law
These Terms are governed by the laws of the Netherlands, except to the extent that mandatory consumer-protection laws of your country of residence apply.
If you are a consumer in the European Union or European Economic Area, nothing in these Terms prevents you from relying on mandatory protections available under applicable law.
